Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Kratings ("we," "us," or "our") regarding your access to and use of our website, services, and applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

Eligibility

You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Kratom products discussed on this platform may be subject to legal restrictions in your jurisdiction. You are responsible for ensuring your use of the Services complies with all applicable local, state, and federal laws.

Account Registration

Account Creation

To access certain features, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Account Responsibilities

You are solely responsible for your account and any activity that occurs under it. You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

AI Assistant

Service Description

Our AI Assistant feature provides personalized kratom recommendations and answers using ChatGPT-5 technology through OpenRouter. The AI accesses our database and your personal data (reviews, stash, usage logs, preferences) to provide tailored responses.

No Medical Advice

IMPORTANT: The AI Assistant is NOT a medical professional and does not provide medical advice, diagnoses, or treatment recommendations. All information is for educational purposes only. The AI cannot prescribe dosages for medical conditions or replace consultation with qualified healthcare providers. Always consult your doctor before using kratom, especially if you have medical conditions or take medications.

AI Limitations and Accuracy

You understand and agree that:

• AI responses are generated by algorithms and may contain errors or inaccuracies
• The AI bases recommendations on community reviews, which reflect individual experiences and may not apply to you
• Vendor and strain recommendations are not endorsements by Kratings
• The AI does not guarantee product quality, safety, or legality
• You use AI recommendations at your own risk and should verify information independently
• Conversation data is stored on our servers and processed through third-party AI services (OpenRouter)

Acceptable Use of AI

When using the AI Assistant, you must not:

• Request medical advice, diagnoses, or treatment plans
• Use the AI for illegal purposes or to promote illegal activities
• Attempt to manipulate or "jailbreak" the AI system
• Generate spam, abusive content, or harmful instructions
• Share personal health information that could identify others
• Use the AI to scrape data or reverse-engineer our systems

Swap Board and User-to-User Trading

Trading Platform

The swap board allows users to list kratom products for trade, sale, or exchange with other community members. Kratings provides the platform for these transactions but is NOT a party to any trades. All transactions occur directly between users.

No Transaction Liability

IMPORTANT: Kratings is not responsible for user-to-user transactions. We do not verify product quality, authenticity, safety, or legality. We do not handle payments, shipping, or delivery. You trade at your own risk. Kratings is not liable for disputes, fraud, damaged goods, non-delivery, or any other issues arising from swap board transactions.

Trading Responsibilities

When using the swap board, you agree to:

• Provide accurate descriptions, photos, and information about products you list
• Only list products you legally own and are legally permitted to sell/trade in your jurisdiction
• Comply with all applicable laws regarding kratom sales, trading, and shipping
• Handle payment, shipping, and delivery arrangements privately with trade partners
• Verify the identity and reputation of trading partners before finalizing transactions
• Resolve disputes directly with trading partners in good faith
• Not use the swap board for commercial sales without vendor authorization
• Not engage in fraudulent, deceptive, or manipulative trading practices

Trader Feedback and Reputation

Users may leave feedback and ratings after completing trades. Feedback is public and contributes to trader reputation scores. You agree that:

• Feedback must be honest, accurate, and based on genuine trade experiences
• You will not manipulate feedback systems through fake trades or coordinated reviews
• Feedback is permanent and cannot be edited or deleted except by moderators
• We may remove fraudulent or abusive feedback at our discretion
• Reputation scores do not guarantee future trade quality or trustworthiness

Legal Compliance

You are solely responsible for ensuring your use of the swap board complies with all local, state, and federal laws. Kratom legality varies by jurisdiction. Some states, counties, and cities prohibit kratom sales or possession. International shipping may violate customs regulations. You must research and comply with all applicable laws before listing or trading products.

Dispute Resolution

If disputes arise from trades, you must attempt to resolve them directly with your trade partner. You may report serious violations (fraud, harassment, safety concerns) to our moderation team, but Kratings has no obligation to mediate disputes, issue refunds, or take action against users. We reserve the right to suspend or ban users who repeatedly violate trading policies.

Stash Tracking and Wellness Tools

Personal Data Ownership

You retain ownership of all data you enter into our stash tracking, usage logs, tolerance breaks, and taper planning features. This data is private by default and only shared with our AI Assistant to provide personalized recommendations. You can export or delete this data at any time.

No Medical Advice or Treatment

Usage logs, tolerance calculators, and taper planners are informational tools only and do NOT constitute medical advice. These features cannot diagnose addiction, recommend clinical treatment, or replace professional healthcare. If you are experiencing kratom dependency, withdrawal symptoms, or adverse health effects, seek immediate medical attention. Our wellness tools are harm reduction resources, not medical interventions.

Data Accuracy

You are responsible for the accuracy of data you enter into stash tracking and usage logs. We do not verify inventory quantities, batch codes, or consumption data. Usage statistics and insights are only as accurate as the data you provide.

User-Generated Content

Content Ownership

You retain ownership of any content you submit, post, or display on the Services ("User Content"). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute your content in connection with operating and promoting the Services.

Content Guidelines

You agree that your User Content will not:

• Contain false, misleading, or fraudulent information
• Violate any third-party rights (copyright, trademark, privacy, etc.)
• Contain hate speech, harassment, or discriminatory content
• Include spam, promotional content, or commercial solicitations
• Contain malicious code, viruses, or harmful software
• Promote illegal activities or substances
• Impersonate any person or entity
• Include personal information of others without consent

Review Guidelines

When posting reviews and ratings, you must:

• Base reviews on genuine personal experience with the product or vendor
• Provide honest, objective, and fair assessments
• Not post duplicate reviews or manipulate ratings
• Not accept compensation for posting positive or negative reviews
• Not post reviews on behalf of competitors or for competitive advantage

Content Moderation

We reserve the right to review, edit, or remove any User Content that violates these Terms or our community guidelines. We may also suspend or terminate accounts of users who repeatedly violate these rules. However, we are not obligated to monitor or review all User Content.

Prohibited Uses

You may not use the Services to:

• Violate any laws, regulations, or third-party rights
• Engage in fraudulent, deceptive, or manipulative practices
• Scrape, crawl, or use automated tools without permission
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services or servers
• Transmit viruses, malware, or other harmful code
• Harass, abuse, or harm other users
• Create multiple accounts to manipulate ratings or voting
• Use the Services for commercial purposes without authorization

Vendor Claims and Verification

Vendors may claim their business profiles on Kratings. When claiming a vendor profile:

• You must provide proof of ownership or authorization to represent the business
• All information provided must be accurate and verifiable
• Claims are subject to admin review and approval
• We reserve the right to deny or revoke claims at our discretion
• Claimed vendors must adhere to additional vendor-specific terms

Intellectual Property Rights

The Services and their original content (excluding User Content), features, and functionality are owned by Kratings and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the Services without our express written permission.

DMCA Compliance

If you believe content on our Services infringes your copyright, please contact us atSupport@Kratings.com with:

• Description of the copyrighted work
• Location of the infringing material
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
• Your physical or electronic signature

Disclaimers and Limitations

No Medical Advice

The information on Kratings, including AI Assistant recommendations, usage logs, tolerance calculators, and taper planners, is for informational purposes only and should not be considered medical, legal, or professional advice. User reviews and ratings reflect individual experiences and opinions. We do not endorse any specific vendors, products, or claims. The AI Assistant is not a medical professional and cannot provide medical diagnoses or treatment. Always consult with qualified healthcare professionals before using kratom or any supplement, especially if you have medical conditions or take medications.

No Guarantees

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or reliability of User Content or ratings. We make no warranties regarding the quality, safety, or legality of products discussed on the platform.

Third-Party Content

We are not responsible for content, products, or services offered by third-party vendors or websites linked from our Services. Any dealings with vendors or third parties are solely between you and them.

Limitation of Liability

To the maximum extent permitted by law, Kratings and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Services
• Any User Content or conduct on the Services
• AI Assistant recommendations, responses, or inaccuracies
• User-to-user transactions, trades, disputes, or fraud on the swap board
• Stash tracking data loss or usage log inaccuracies
• Unauthorized access to or alteration of your data
• Actions of third-party vendors, products, or service providers (including OpenRouter)
• Any health consequences from following AI recommendations or user reviews
• Any other matter relating to the Services

Indemnification

You agree to indemnify, defend, and hold harmless Kratings and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your violation of these Terms, (b) your User Content, (c) your use of the Services, or (d) your violation of any third-party rights.

Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination will survive.

Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us atSupport@Kratings.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the federal or state courts located in the applicable jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

Miscellaneous

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kratings.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
